FSCA on annual regulatory actions

The Financial Sector Conduct Authority (FSCA) has launched its second edition of the Regulatory Actions Report, showcasing its efforts to combat financial malfeasance and uphold industry standards. In a recent interview with CNBC Africa, Gerhard Van Deventer, Divisional Executive of Enforcement at FSCA, shed light on the agency's focus on addressing emerging challenges such as deep fakes and scams plaguing the financial sector. Van Deventer highlighted the prevalence of deep fake videos, emphasizing the sophistication of artificial intelligence in creating convincing yet fraudulent content. The FSCA's primary objectives include ensuring the compliance of regulated entities with industry regulations and keeping fraudulent actors out of the financial industry. Scams, impersonations, and fraudulent schemes continue to pose significant risks to consumers and investors, with perpetrators often targeting well-known personalities and financial services providers to deceive the public. The report revealed that the FSCA imposed penalties amounting to over R943 million in the past year, underscoring the agency's commitment to enforcing regulatory standards and combating financial misconduct. Notable penalties, such as the R475 million fine on Marcus Jooster, reflect the severity of violations and the harm inflicted on the public. Van Deventer discussed the criteria for determining penalties, which consider factors like the extent of harm, gains for wrongdoers, cooperation, and intentional misconduct. In addition to monetary penalties, the FSCA actively debars individuals from the industry, suspends and revokes licenses, and collaborates with law enforcement agencies to prosecute offenders. Van Deventer acknowledged the agency's role in supporting investigations by the National Prosecuting Authority and the Hawks, leading to successful prosecutions and significant penalties. The case of BHI Trust exemplified the collaborative efforts that resulted in a 25-year imprisonment for the offender, emphasizing the impact of concerted action against financial crimes. While discussing the high number of license suspensions and withdrawals, Van Deventer clarified that most cases were related to non-compliance with reporting requirements and levies rather than misconduct.
