KICTANet’s role in policy, data protection and emerging technologies

KICTANet, a pivotal player in shaping ICT policies and advocating for data governance in Kenya, has been at the forefront of driving progress in data protection in the country. Since the enactment of the Data Protection Act in 2019, Kenya has witnessed commendable steps towards ensuring the protection of personal data and enforcing penalties against violators. The establishment of the Office of the Data Protection Commissioner (ODPC) has significantly contributed to the implementation of the Data Protection Act and the protection of data subjects' rights. Valarie Waswa, Legal Fellow at KICTANet, emphasized the significant strides that have been made in the past five years following the enactment of the Data Protection Act. The ODPC has played a crucial role in imposing penalties on entities that violate data privacy rights, serving as a deterrent to others. Despite these advancements, challenges persist, notably in the registration of data handlers and creating awareness, especially in rural and marginalized communities. Collaboration between the government, private sector, civil society organizations, and other stakeholders is deemed essential to enhance public awareness on data protection rights and compliance. Valarie underscored the importance of incentivized measures, such as tax incentives, to encourage businesses to invest in creating awareness campaigns about the Data Protection Act. In shaping the landscape of emerging technologies like blockchain and artificial intelligence (AI), KICTANet is actively engaging stakeholders through its virtual network of over 800 members. By fostering dialogue and collaborations, KICTANet aims to ensure that policies around these technologies are human-centered and uphold data protection and privacy. The interview also delved into the intricate balance between regulation, innovation, and data sovereignty in cross-border data transfers. Valarie highlighted the necessity of agreements and regulations that protect individuals' data while fostering innovation and economic growth. Furthermore, the discussion touched on the imperative need for policy interventions to promote affordable internet and broadband expansion in Kenya. Valarie emphasized the importance of holding stakeholders accountable to ensure the implementation of policies that enhance internet accessibility, particularly in rural areas. Encouraging competitiveness among telecom and internet service providers was identified as a vital strategy to lower internet costs and bridge the digital divide.
